Terms of Service

These Terms of Service (the "Terms") govern your use of Whisper (the "Service") operated by Kirill Dorkin (MicroStudio), Kyrgyz Republic ("we", "us", "Operator").

The Service includes the website, backend API and the Whisper desktop application. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • Service: Whisper and related websites/apps/APIs.
  • Token (activation key): a unique string that grants access to the Service features.
  • Trial: limited free access for evaluation purposes.
  • Paid access: access provided after payment and issuance of a token.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

3. Token-based access and security

  • Access is provided via a token. Keep it confidential and do not share it.
  • Any actions performed using your token are deemed to be performed by you.
  • We may suspend or disable a token if we suspect compromise, fraud, abuse, violations of these Terms or legal requirements.
  • The Service may apply usage and budget limits (for example usage/limit) to control costs and prevent abuse. Limits can differ by plan and may change over time.

4. Free Trial (Try for Free)

  • Trial tokens are intended for evaluation only and are time/limit restricted.
  • The trial timer typically starts on first authorized use (activation in the app) and lasts for a short period (for example 10 minutes).
  • To prevent abuse we may apply technical limits (for example one trial per device/time period, IP-based limits, and concurrency limits).
  • We may change, limit or discontinue the trial at any time without notice.

5. Payments, checkout and subscriptions

  • Payments are processed by third-party payment providers (for example Paddle, Cryptomus and others). Your payment may be subject to the provider’s own terms and policies.
  • For international card payments, Paddle may act as the merchant of record. In that case, Paddle may handle taxes (VAT/sales tax) and your card statement may reference Paddle.
  • After successful payment we issue an activation token, typically by email. You are responsible for providing a valid email address and checking spam/junk folders.
  • Some plans may be sold as subscriptions with automatic renewals. If applicable, renewal and cancellation rules are displayed at checkout and managed through the payment provider’s interface.

6. Acceptable use

You agree not to:

  • break applicable laws or third-party rights;
  • use the Service to intercept, monitor or record communications and/or screens without required notices, consents and a lawful basis;
  • attempt to bypass security controls, limits, billing or anti-abuse mechanisms;
  • use bots or automated scripts without our written permission;
  • reverse engineer, decompile or attempt to extract source code or confidential logic except to the extent permitted by law;
  • upload or share confidential information of third parties, trade secrets, or personal data without a lawful basis and required consents.

You are solely responsible for ensuring that using the Service in a particular situation (including interviews) is allowed and does not violate employer rules, NDAs, policies or other obligations.

7. Intellectual property

The Service, its software, design, content and trademarks are owned by MicroStudio or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes for the duration of your valid token/subscription.

8. AI disclaimer

  • The Service relies on AI models and may produce incorrect, incomplete or outdated outputs.
  • The Service does not provide legal, financial or professional advice. You are responsible for how you use the output.
  • We do not guarantee any outcome (including getting an offer or passing an interview). The Service is provided "as is" and "as available" to the maximum extent allowed by law.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profits, reputational harm, third-party decisions (for example employers), or outages caused by networks, payment providers, AI providers or other third parties. Our aggregate liability for any claims is limited to the amount you paid for the relevant paid access, unless mandatory law requires otherwise.

10. Termination

We may suspend or terminate access (including disabling a token) for violations, abuse, suspected fraud, legal requirements, or to protect the Service. You may stop using the Service at any time.

11. Changes

We may update these Terms. The new version becomes effective when published on the website. Continued use of the Service means acceptance of the updated Terms.

12. Governing law and disputes

Unless mandatory law requires otherwise, these Terms are governed by the laws of the Kyrgyz Republic. If mandatory consumer protection laws of your country of residence grant you additional rights, those laws apply to the extent required. Any disputes shall be resolved in the competent courts at the Operator’s location in the Kyrgyz Republic, unless mandatory law provides otherwise.
